Terms of Use for Pondiful and Koi Sort

These terms are an agreement between you and Nazford Games ("Nazford", "we"), who makes Pondiful and Koi Sort ("the games"). By playing the games you accept them. If you're under 18, or under the age of majority where you live, a parent or guardian must accept them for you. Our privacy policy at https://nazford.com/privacy/ explains how the games use information.

Playing the games

We give you a personal, non-transferable licence to download the games and play them for your own enjoyment. The games, their art, music, characters and code belong to Nazford Games or its licensors. Please don't copy, sell, decompile or modify them, or use bots, cheats or bugs to get an advantage. Open-source parts (such as the Fredoka font, under the SIL Open Font License) keep their own licences.

Purchases and the Koi Club

Buying. Purchases are made and paid through Google Play or the App Store, under their terms. Prices are shown in your local currency before you buy.

Petals and other in-game items (such as Pond Pass tiers, decorations and looks) are a licence to use them in the game. They have no value outside the game and can't be exchanged for money or moved to another player. Nothing you buy changes the pieces, the board or the scores: the games are equally fair for everyone.

Remove Ads turns off the ads that appear on their own. Ads you choose to watch for a reward stay available, and stay optional.

Koi Club is a monthly subscription. It renews automatically at the price shown until you cancel it in your Google Play or App Store account settings, at least 24 hours before it renews. Cancelling keeps the Club until the end of the month you've paid for.

Refunds follow Google Play's or Apple's refund policies, and the consumer law where you live.

Progress is stored on your device. Uninstalling the game or losing your device can lose it, including items you bought; Restore Purchases in Settings brings back your one-time purchases (such as Remove Ads) and an active Koi Club.

Ads

The free games show ads from Google AdMob. Some ads are optional: you can watch one for a reward, and "No thanks" is always one tap. Ads are chosen and shown by Google under its own terms; we don't control their content, but you can report an unsuitable ad to support@nazford.com.

Online features and fair play

Duels, Leagues, Friends, seed leaderboards and ghost matches (Pondiful) use our server and are optional. Please be kind:

• Choose a name that isn't rude, hateful or sexual, doesn't pretend to be someone else (including us) and doesn't share contact details. Names are checked, and other players can report a name.
• Don't cheat, use bots, tamper with the games or the server, or try to get around a limit.

If a name breaks these rules we may remove it. If someone cheats or abuses the online features, we may remove their scores or stop them using the online features. Online features, events and the daily puzzles may change, pause or end; we'll give notice in the game where we reasonably can.

Changes and ending

We may update the games and these terms. If a change matters to you, we'll mention it in the game or on this page and update the date above; playing after that means you accept the new terms. You can stop playing at any time by uninstalling the games. We may stop offering a game; if we do, we'll give notice where we reasonably can.

Our responsibility to you

We work hard to make the games reliable and fair, but they're provided "as is": we can't promise they'll always be available or free of bugs. To the extent the law allows, we're not responsible for indirect losses, and our total responsibility to you is limited to what you paid us in the 12 months before the claim. Nothing in these terms takes away rights you have under consumer law that can't be excluded, wherever you live.

App Store

If you got a game from Apple's App Store, these terms are between you and Nazford Games, not Apple, and Apple's Licensed Application End User Licence Agreement also applies (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). Apple has no duty to support the game.

Law and disputes

These terms are governed by the laws of India, and the courts of Mumbai, Maharashtra handle disputes, except where the law of your country gives you the right to use its courts or its consumer protections. Please write to us first: most problems can be solved by email.
